



















Travel conditions for trips with Travel and Learn AS
The purpose of the travel guarantee scheme is to protect customers who have purchased package holidays against losses in the event of bankruptcy, composition or insolvency of the organiser. The customer is protected by law when purchasing package holidays if the organiser has provided a guarantee in Norway. The fund thus pays back advances that the customer has paid when a trip is cancelled. In the event of a trip interruption, the part of the consideration corresponding to the unfulfilled service is paid. Furthermore, expenses for accommodation and return travel are covered if the return journey is part of the package holiday. Package holidays are regulated by the Package Holidays Act with regulations.
Defects after departure
The package tour is defective when it deviates from what has been agreed or assumed in the agreement, and this is not due to the traveler or circumstances on his part. Deviations from the agreement are not considered defects if they are of minor importance, or are of a nature that the traveler must expect to occur from time to time. The same applies to deviations in natural conditions that the organizer neither had nor should have had knowledge of or control over. The traveler is obliged to complain about defects that he discovers as soon as possible. Complaints that are submitted later than the deadlines in these terms and conditions clause 9 will normally mean that the traveler's possible rights lapse. Defects that are eligible for complaint after departure give the traveler the following rights:
a) Remedies:
The traveler may demand that the arrangement remedy the defect if this can be done without unreasonable cost or inconvenience to Hamk. The remedy must be done within a reasonable time and without significant inconvenience to the traveler. If the traveler refuses a remedy that would remedy the defect, he loses the right to further claims.
b) Price reduction:
If the defect is not remedied, the traveler is entitled to a proportionate price reduction, or possibly coverage of reasonable expenses incurred by the traveler in rectifying the defect himself when the organizer has not been able to do so.
c) Cancellation of the trip:
If the package travel has significant defects and the purpose of the package travel is therefore significantly impaired, the traveler may cancel the agreement and claim back the amount paid in accordance with the agreement. If the traveler cancels the agreement in accordance with this provision, he is entitled to free transport back to the place of departure or another place where the trip was to end, if the package travel contains a transport element.
d) Compensation:
The traveler is entitled to compensation for losses or expenses that may result from the defect in accordance with the rules in Section 6-4 of the Package Travel Act. He may also claim compensation for non-economic loss (“compensation”) if the defect has caused major inconvenience to the customer.
Where defects arise in connection with transport, any compensation rules in special transport law apply before the compensation provisions in the Package Travel Act. The traveller can choose whether to claim compensation for his loss from the organiser or directly from the carrier. Regardless of whether the organiser is liable for compensation in accordance with the above, the traveller is obliged to limit the loss as best he can. Compensation cannot be claimed for loss or damage caused by the traveller's own negligence or circumstances.
The following circumstances are normally not considered to be defects according to the provisions of this section:
I. Deviations from the agreement that are of minor importance for the implementation of the journey or that have not had any impact on the choice of package travel.
II. Deviations from the traveller's expectations that were not created by the organiser, such as different building standards at the destination or other conditions related to the destination, if the conditions the traveller complains about must be considered to be "usual" at the destination.
III. Abnormal weather and other natural conditions that the organizer did not or should have known about.
IV. Conditions that the traveler must expect to occur from time to time, and that are beyond the organizer's control or that do not deviate from what is considered to be expected in the agreement. Change of residence due to overbooking shall not be considered "foreseeable deviations".
V. Delays during transport or services, when the stay at the destination is not shortened by more than a maximum of 6 hours for trips lasting less than 5 days, or 8 hours for trips lasting between 5 and 8 days, or a maximum of 12 hours for trips lasting more than 8 days. If the delay/change in departure/arrival times is due to measures from aviation authorities, exceptional weather conditions, demanding airspace or other similar conditions that cannot be influenced by the organization or transport, the deadlines specified above are doubled.
VI. Deviations from the agreement that are due to the traveler's own circumstances.
The traveler has the right to transfer the trip to another person who meets the conditions for participating in the package tour. The prerequisite is that the organizer is notified of this within a reasonable time before the package tour starts, and that the organizer and/or subcontractors he uses are not bound by rules that prohibit such transfer. The organizer charges a name change fee of NOK 750 per person. The original customer and the new traveler are jointly and severally liable for both such fee and any remaining amount for the trip. The organizer's duty to provide information pursuant to Chapter 3 of the Package Travel Act is normally deemed to have been fulfilled towards the new customer to the extent that the duty to provide information has been fulfilled towards the person transferring the trip. If there is a need to provide additional information, and this is practically possible, the organizer will nevertheless be obliged to provide the necessary information to the person to whom the trip has been transferred.
In cases where airline tickets are involved, the organizer is obliged to comply with certain airline rules. In such cases, the airline's rules regarding name changes or cancellations apply.
Passport / miscellaneous
Please note that the passport must be valid for at least 6 months after the return date. All participants must be able to handle their own luggage and travel without assistance en route. Special needs en route must be stated when registering.
Program and Price Changes
All trips are subject to price changes due to circumstances beyond our control. This primarily applies to currency changes and increases in taxes and/or fees. Unless otherwise stated in the program brochure, the price is based on 10 paying participants. In the event of a deviation from this number, Travel and Learn has the right to change the price. In the event of a price increase of more than 10%, the customer has the right to cancel the agreement. Information about flight times and airlines is provisional until the flight ticket has been issued. In addition, reservations are made for possible printing errors. Significant changes that occur after booking a trip must be notified to the traveler in writing.
The organizer has the right to transfer the travelers to another accommodation that is better suited to the size of the remaining group and that otherwise corresponds to the originally booked accommodation. The right to such a transfer is conditional on the transfer not reducing the content of the selected package tour, or causing the information provided about the package tour or agreed additional services to no longer be fulfilled.
Registration
Registration is binding and implies acceptance of the tour's travel conditions. Everyone benefits from registration as early as possible. Some tours have a registration deadline that is stated in the tour program. We will try to follow up on registrations after the deadline. In such cases, please contact us to inquire about available places. For guests traveling alone and wanting a double room, we will arrange room allocations as far as possible.
Payment terms
Deposits are invoiced when we receive registration. The final invoice for the trip is due 35 days before departure, unless otherwise agreed between the parties. Travel documents and tickets are validated and sent to the traveler when Travel and Learn receives payment. The deposit amount paid is deducted from the final invoice.
Deposit
When Travel and Learn AS receives registration, a deposit of NOK 1,500 is invoiced for trips in Europe and NOK 3,000 for trips in the rest of the world. In special cases, payment obligations to subcontractors may result in higher deposit amounts, and in some cases this is also non-refundable. In such cases, this is stated in the program brochure or communicated in writing by this.
Traveler's obligations
The traveler is obliged to pay the agreed fee within the deadline set out in the terms and conditions. Significant payment default entitles the organizer to cancel the booking.
The traveler is obliged to provide the organizer with the relevant information that he understands or should understand is of significant importance for the implementation of the package tour. The traveler is further obliged to familiarize himself with the organizer's travel conditions and the conditions that the organizer has included in its catalog or otherwise, and to comply with the complaint deadlines stated in section 9 of these terms and conditions.
The traveler is obliged to bring a valid passport, any visa, health certificates, tickets and other documents that may be necessary for the trip. The traveler is obliged to obtain such documents that may be necessary for the individual trip, and he is obliged to take out any insurance that he may feel is necessary. The organizer has the right to reject a traveler if the necessary documents are not brought with him.
The traveler is also obliged to comply with the organizer's own regulations as presented to him before the conclusion of the agreement, the rules of conduct of the hotels and other sub-suppliers, and to comply with the rules of the carrier and the local authorities. The traveler must also comply with the instructions given by the organizer regarding meeting time, meeting place, etc. during the trip, as well as any instructions given by the carrier or transport manager in connection with unforeseen events during the trip. The individual participant in the trip must not behave in a way that is a nuisance to fellow travelers or creates safety or practical problems for the organizer. The organizer has the right to reject a traveler at the start of the trip if the traveler's behavior or condition makes it obvious that he cannot meet the requirements in this section.
A serious violation of these regulations after the matter has been reported gives the organizer the right to refuse the traveler in question further participation in the trip. The organizer is then not responsible for additional expenses in connection with an advanced/changed return trip. The rejected traveler may also not make claims regarding the part of the trip that is not used.
The traveler is obliged to comply with any provisions of the organizer regarding confirmation of return tickets on scheduled flights. If this is not done, the reserved seats cannot be expected to be used. Furthermore, the traveler is obliged to keep informed of any changes in the departure time, by contacting the organizer's representative if the traveler has removed himself from the travel company or otherwise made himself/herself unavailable in the last 24 hours before the scheduled departure. The traveler is otherwise obliged to follow the organizer's requests to read the organizer's notices, visit the information desk or reception as long as this does not cause unnecessary trouble or inconvenience to the traveler.
The traveler may be held liable for losses or additional expenses incurred by the organizer in the event of a gross violation of the above provisions. The traveler is liable for damage, etc. according to the usual rules of tort law.
Anyone who books a package tour on behalf of others is obliged to ensure that the person(s) who will participate in the package tour can follow the regulations set by the organizer, and that the package tour in question is of such a nature that the person(s) registered can participate in it without burdening themselves or others.
Travel conditions
We refer to the general travel conditions. These rules apply to our group tours unless there are special travel conditions for the tour in question. Such special travel conditions are in that case stated in the program brochure for the individual tour.
Complaints
The traveler is obliged to notify the organizer within a reasonable time if he discovers a defect that would give him rights under points 8 a) - d). If the defect is discovered after the package tour has begun, the traveler must, as far as possible, complain on site. In any case, the complaint must be submitted to the organizer no later than 4 weeks after the end of the tour, unless special reasons make it reasonable to extend the complaint deadline.
Final invoice
The final invoice will be sent out so that payment is received 30 days before departure. In special cases, payment obligations to subcontractors may mean that payment must be made earlier. In such cases, this is stated in the program brochure or communicated in writing.
Dispute resolution
In the event of a complaint, the traveler shall be made aware of the complaints procedure, and that if the traveler's complaint/claim is not met or the parties reach an agreement, the matter may be brought before the Complaints Board for Corporate Travel or another dispute resolution body.
The buyer accepts Oslo District Court as the place of jurisdiction. Any lawsuit against the organizer shall be governed by Norwegian law.
In the event of unforeseen serious illness or accident - voluntary cancellation insurance
If cancellation insurance has been taken out when booking, the traveler has the right to demand release from the agreement if he can document that the conditions for such cancellation have been met. He is obliged to notify the organizer of the cancellation as soon as possible after he becomes aware of the circumstances that give rise to the right to cancellation under this point. The cancellation insurance agreement cannot be terminated during the agreement period. When using a medical certificate as documentation for sudden and serious illness, this should be drawn up on the form prepared by the Norwegian Medical Association and the Norwegian Medical Association, if the traveler has been given such a form by the organizer upon cancellation. The traveler must contact his insurance company as soon as possible after he becomes aware of being prevented from traveling.
Cancellation insurance gives the right to cancel if the traveler himself, his spouse, registered partner, cohabitant, children, parents, parents-in-law or siblings are affected by sudden and serious illness, accidental injury or death. The same applies if such circumstances affect someone with whom he is traveling, and it would be unreasonable to require the traveler to then complete the trip without that person being with him. Sudden and serious incidents that affect the traveler or his traveling companions, cf. above, and which result in it being unreasonable to require the traveler to complete the trip are considered to be equivalent to sudden and serious illness. Such incidents may include fire or water damage to real property, etc. The right under the preceding paragraphs assumes that the traveler himself was not aware of, or should have been aware of, the circumstances that lead to the trip not being used, or that he himself is not responsible for such circumstances.
The traveler is obliged to notify the organizer of the cancellation as soon as possible after he is aware of the circumstances that justify the cancellation under this paragraph, and to provide sufficient documentation of the illness from a doctor, or the preventing circumstance, for example by a certificate from a police authority or insurance company.
Documentation regarding the reason for cancellation must be submitted no later than 1 month after the cancellation was made directly to the traveler's insurance contact.
If the booking includes several travelers, and the total price reflects a discount or reduction based on the total number of participants, a cancellation for one or more of the group may result in the conditions for the agreed price no longer being met. This shall not result in a price increase for the remaining participants, but is covered by the cancellation insurance.
Our travel conditions are based on the General Terms and Conditions for Package Travel, which have been prepared by the Norwegian Travel Forum (NRF) in collaboration with the Consumer Ombudsman (FO). The terms and conditions apply to package travel that falls under the definition in the Package Travel Act of 25.8.1995, Section 2-1, i.e. the trip contains at least two of the following elements: Transport, accommodation and/or other tourist services that are considered an essential part of the package. Furthermore, the combination must be arranged in advance, sold or marketed at a total price and have a duration of more than 24 hours or include an overnight stay. The terms and conditions have been drawn up in accordance with the Package Travel Act (“Package Travel Act”) and the Ministry of Children and Family Affairs’ regulations to the Act, (“Regulations”) and supplement the provisions of the Act and the regulations. The terms and conditions apply to all package travel that falls under the Package Travel Act with regulations. The terms and conditions regulate the relationship between the tour operator and the customer.
YOUR SAFETY
The organizer's right to change the content or conditions of the trip after the conclusion of the agreement
The organizer cannot change the terms of the agreement or the specifications of the trip to the disadvantage of the traveler after the conclusion of the agreement, unless a reservation has been made to change specifically stated benefits/specifications, and this is expressly stated in the individual agreement, i.e. travel voucher or other agreement document. See information on “Program changes”.
The organizer is obliged to notify the traveler in writing as soon as possible if he wishes to change the conditions or content according to this point. The traveler has the right to cancel the purchase if the changes result in the trip suffering from significant deficiencies, or he can demand a price reduction if the trip will be deficient. If the traveler has not invoked this right within three days of notification of the change, he loses the right to cancel the purchase or demand a price reduction. If special circumstances mean that the deadline cannot be met, the traveler is obliged to notify as soon as possible and within a reasonable time.
Cancellation insurance and travel insurance
Travel and Learn AS recommends that all travelers take out cancellation insurance from an insurance company, together with the package tour itself, which ensures the traveler's right to claim release from the contract in the event of sudden serious illness of themselves or someone in their immediate family, or someone they are traveling with, or other unexpected and serious incidents.
Travel insurance for loss/damage to luggage etc. and for coverage of medical expenses and possible repatriation in the event of accident/illness is strongly recommended to be taken out by all travelers with an insurance company. It is also recommended to bring the Social Insurance Agency's form E111/Health Card with you on your trip. If the purchase agreement is entered into shortly before departure, information according to the previous paragraph must be provided to the extent practically possible.
Travel and cancellation insurance All travelers must have travel insurance. The traveler is responsible for taking out the insurance they want. Travel and Learn recommends that everyone take out cancellation insurance in addition to the travel insurance itself. Check whether your travel insurance already includes this. If it does not include cancellation insurance, this should be taken out with the insurance company when booking the trip.
If the booking includes several travelers, and the total price reflects a discount or discount based on the total number of participants, a cancellation for one or more of the group may result in the conditions for the agreed price no longer being met. This shall not result in a price increase for the remaining participants, but is covered by the cancellation insurance.
Cancellation due to force majeure
Cancellation due to force majeure The trip may be cancelled if acts of war, natural disasters, dangerous infectious diseases or other events that must be equated are observed at the destination or in the immediate vicinity of this in the last 14 days before the trip begins, and there is reasonable reason to assume that these conditions will also apply when the trip is to begin.
The trip may not be cancelled for the aforementioned reasons if the event that is invoked as a reason for cancellation was or should have been known before booking.
We will do our utmost to ensure that booked trips are carried out as planned or with necessary changes if something unforeseen should arise. If external circumstances (“force majeure”) make it impossible to carry out the travel arrangement, this normally does not result in a refund of the amount paid.
Travel and Learn follows the Ministry of Foreign Affairs' travel advice.
Cancellation with payment
Cancellation must be made in writing. Failure to pay the deposit does not count as cancellation. In the event of cancellation or no-show, the following fees apply:
Up to 120 days before departure: NOK 750 per person
From 119 to 60 before departure: The deposit amount
From 59 to 35 days before departure: 50% of the trip price
Less than 35 days before departure: No refund
In some cases, the cancellation rules may deviate from this due to stricter rules from airlines and our suppliers. In such cases, this is stated on the website or in the tour program. No refund will be given if you lack the necessary documents (passport and visa) to participate in the entire trip. If you have travel insurance, you can apply for a refund from your insurance company.
Cancellation with special rules or deviations from normal cancellation rules
In some cases, the cancellation rules may differ, due to stricter rules from airlines and our suppliers. In such cases, this is stated on the website or in the tour program. The following tours are subject to special rules: tours with closed groups, senior tours, cruises, tours outside Europe, tours during holidays such as Easter, Christmas and New Year and tours where it is specified in the brochure. Please contact us when you register for the tour.
When registering, a deposit of NOK 2500 / NOK 5000 (specified in the brochure) per person is required. The remaining amount is due approximately 2-3 months before departure.
If the trip is cancelled between 150 days and 121 days before the departure date, a fee of NOK 2,500 will be charged.
If the trip is cancelled between 120 days and 91 days before the departure date, a fee equivalent to the deposit paid will be charged.
If the trip is cancelled between 90 days and 61 days before the departure date, 50% of the trip price will be charged.
If the trip is cancelled 60 days or less before the departure date, or in the event of a no-show on the day of departure, 100% of the trip price will be charged.
The same applies if you lack the necessary documents to participate in the entire trip.
No refund will be given if you lack the necessary documents (passport and visa) to participate in the entire trip. If you have travel insurance, you can apply to have the amount refunded to your insurance company.
In some cases, the rules may differ, due to payment obligations and deposit requirements from subcontractors. In such cases, this is stated in the relevant program brochure.
Cancellation or postponement
A group tour with too few registered participants may be cancelled. The same can happen if other decisive reasons mean that the tour cannot be carried out. Those registered will then be given the choice between another tour or a refund of the amount paid. Cancellation or postponement of the tour must be notified personally to the participants. This must be done as soon as possible and no later than 30 days before departure.
Force Majeure
We will do our utmost to ensure that booked trips are carried out as planned or with necessary changes if something unforeseen should arise. If external circumstances (“force majeure”) make it impossible to carry out the travel arrangement, this will normally not result in a refund of the amount paid.
Reservations
The price is based on known taxes, fees and exchange rates as of the date specified in the brochure and the minimum number of participants in the group. In the event of fewer registrations, we reserve the right to increase the price or, in the worst case, cancel the trip. In such a case, notice will be given no later than 30 days before departure. We also reserve the right to make necessary changes to the itinerary, times, hotels, etc., both before departure and after the trip has started.
The organizer has the right to transfer the travelers to another accommodation that better suits the size of the remaining group and that otherwise corresponds to the originally booked accommodation. The right to such a transfer is conditional on the transfer not reducing the content of the selected package tour, or causing the information provided about the package tour or agreed additional services to no longer be fulfilled.
Too few registrations
The organizer may cancel a trip if a sufficient number of travelers do not register. In such a case, the cancellation must occur no later than 30 days before departure. The organizer reserves the right to cancel a trip if less than 95% of the available seats have been sold. If a trip that the organizer has the right to cancel in accordance with the previous point is part of a series of trips, the organizer has the right to cancel other trips that are part of the same series, provided that information is provided as soon as possible, and no later than 30 days before departure. The organizer is obliged to notify the traveler of cancellation according to this point as soon as possible. In the event of cancellation according to this point, all amounts paid shall be refunded as soon as possible.
General terms
Travel and Learn acts as an intermediary between the customer on the one hand and the airline, agent and hotels on the other hand. Thus, the organizer cannot be held responsible for delays/cancellations or expenses due to accidents, damage or theft. In the event of unforeseen events, or "force majeure", it may be necessary to make program changes such as rescheduling the itinerary, changing means of transport, accommodation, etc. Reference is otherwise made to the Package Travel Act of 22.12.1995, as well as the General Terms and Conditions for Package Travel of 01.04.2007 and in particular their wording that "Information provided in catalogues or brochures or other information material that the organiser has prepared or refers to is considered part of the agreement" (Prl § 3-2) and "the agreement also includes any individual conditions of the organiser." (AvfP, section 2). Travel and Learn reserves the right to change information before the agreement is concluded.
Health and fitness
All participants must be able to handle their own luggage and be able to travel without assistance. Special needs on the flight and during the trip must be stated when registering.
Obstacles beyond the organizer's control
The organizer may cancel a trip without liability if the organizer can prove that it cannot be carried out as a result of obstacles that are beyond the organizer's control and that the organizer could not reasonably be expected to have taken into account when the agreement was concluded, and that neither the organizer nor anyone for whom the organizer is responsible could avoid or avert the consequences of. Such obstacles may, depending on the circumstances, be war or acts of war, natural disasters, dangerous infectious diseases or other events that must be equated with the aforementioned. If a trip is canceled before it starts due to obstacles beyond the organizer's control, the organizer is obliged to refund the traveler all amounts paid immediately. Alternatively, the traveler has the right to participate in another package tour if the organizer can offer this. If the trip is more expensive than the original one, the traveler must pay the difference. If it is cheaper, the traveler can demand a refund of the difference.
Under the same conditions as mentioned in paragraph 1, the organizer will not be liable for damages if the package tour becomes defective as a result of such obstacles occurring after the package tour has begun. If the tour is shortened by the organizer or the traveler canceling it due to such circumstances, the traveler will still be entitled to a proportional price reduction. The organizer is obliged to eliminate any risk or inconvenience to the traveler to the extent possible. If the tour must be canceled, the organizer is obliged to transport the traveler back to the agreed place of return free of charge and with the least possible inconvenience to the traveler. If the organizer fails to do so and the traveler has to arrange for the return trip themselves, the organizer is liable for any additional expenses incurred by the traveler as a result of this.
