1. Pricing and Participation
  • Price Basis:
    The price is based on known taxes, fees, and exchange rates as of the date specified in the brochure. It also considers a minimum number of participants in the group.

  • Price Adjustments and Cancellation:
    If fewer participants register, the organizer reserves the right to increase the price or cancel the trip. Notice of cancellation will be given no later than 30 days before departure.

  • Changes to Itinerary:
    The organizer may adjust the itinerary, times, hotels, or other trip details as necessary, both before departure and after the trip has commenced.

2. Accommodation Changes
  • Transfer to Alternative Accommodation:
    The organizer may transfer travelers to another accommodation that better suits the group size, provided it matches the originally booked accommodation’s standard and does not affect the package content or agreed additional services.

3. Insufficient Registrations
  • Cancellation Due to Insufficient Participants:
    If there are too few participants, the organizer may cancel the trip. This will occur no later than 30 days before departure.

  • Cancellation Policy for Series Trips:
    The organizer may cancel all trips in a series if less than 95% of available seats are sold, provided notice is given at least 30 days before departure.

  • Refund Policy:
    In such cases, all paid amounts will be refunded as soon as possible.

4. General Terms and Conditions
  • Role of Travel and Learn:
    Travel and Learn acts as an intermediary between the customer and airlines, agents, and hotels. The organizer is not liable for delays, cancellations, accidents, damages, or theft.

  • Force Majeure:
    Unforeseen events (e.g., war, natural disasters, infectious diseases) may necessitate program changes. Reference is made to the Package Travel Act (22.12.1995) and General Terms and Conditions for Package Travel (01.04.2007).

5. Health and Fitness
  • Traveler’s Responsibilities:
    Participants must handle their own luggage and travel unassisted. Any special needs must be disclosed during registration.

6. Obstacles Beyond the Organizer's Control
  • Right to Cancel Due to Force Majeure:
    The organizer may cancel the trip if unforeseen obstacles (e.g., war, natural disasters, infectious diseases) occur.

  • Refunds:
    Amounts paid will be refunded immediately, or the traveler may join another package tour (price differences will apply).

  • Liability During the Trip:
    If such obstacles occur after the trip begins, the organizer is not liable for damages but will strive to minimize inconvenience. Proportional price reductions may apply if the trip is shortened.

7. Defects After Departure
  • Definition of Defects:
    A trip is considered defective if it significantly deviates from the agreement, excluding minor deviations or circumstances beyond the organizer’s control.

  • Complaint Obligation:
    Travelers must report defects immediately. Late complaints may void their rights.

  • Remedies for Defects:

    • Remediation: The organizer must remedy defects promptly without significant inconvenience.

    • Price Reduction: If defects are unresolved, travelers are entitled to a proportionate price reduction.

    • Trip Cancellation: Significant defects impairing the trip’s purpose allow travelers to cancel and seek refunds.

    • Compensation: Travelers may claim compensation for losses or inconvenience unless caused by their own negligence.

8. Exclusions from Defects

The following are not considered defects:

  1. Minor deviations from the agreement.

  2. Unexpected destination-related conditions (e.g., different building standards).

  3. Unusual weather or natural conditions.

  4. Overbooking that results in reasonable accommodation changes.

  5. Transport delays or time changes that do not significantly affect the trip.

  6. Issues arising from the traveler’s own circumstances.

9. Transfer of the Trip to Another Person
  • Right to Transfer:
    Travelers may transfer their trip to another eligible person if the organizer is notified in advance.

  • Fees:
    A name change fee of NOK 750 per person applies. The original and new travelers are jointly liable for all costs.

  • Airline Rules:
    Transfers are subject to airline regulations regarding name changes or cancellations.

10. Passport and Miscellaneous Requirements
  • Passport Validity:
    Passports must be valid for at least 6 months after the return date.

  • Special Needs:
    Travelers with special needs must disclose them during registration.

11. Program and Price Changes
  • Circumstances Beyond Control:
    Prices are subject to change due to currency fluctuations, taxes, or fees.

  • Provisional Flight Information:
    Flight times and airlines remain provisional until tickets are issued.

  • Price Increase Policy:
    Travelers may cancel the agreement if the price increase exceeds 10%.

  • Alternative Accommodations:
    The organizer may adjust accommodations to suit group sizes, ensuring no reduction in package content.

12. Registration
  • Binding Registration:
    Registration is binding and indicates acceptance of the travel conditions.

  • Deadlines:
    Registrations after deadlines are subject to availability.

  • Room Sharing for Solo Travelers:
    Efforts will be made to arrange shared accommodations for solo travelers seeking double rooms.

13. Traveler’s Obligations

Travelers must:

  • Follow the organizer’s instructions.

  • Avoid causing inconvenience or harm to others.

  • Ensure they meet entry requirements (e.g., visas, vaccinations).
    Failure to comply may result in termination of participation without refund.

14. Liability
  • Limitation of Liability:
    The organizer is not liable for delays, cancellations, or damages caused by third parties, unforeseen events, or the traveler’s negligence.

  • Traveler’s Responsibility to Mitigate Losses:
    Travelers must take reasonable steps to minimize losses.
